Good morning from Helena!

Yesterday, the House Business and Labor Committee heard the 10 pm bill – HB 185, sponsored by Rep. Dave Fern (D-Whitefish). We expect the committee to vote on the bill this Friday. We can get HB 185 out of committee but we have work to do.

I want to thank everyone who braved icy roads to be there for the hearing. Our side did great, with a broad representation showing support from brewers across the state, barley growers, craft maltsters, hops growers, beer lovers and local business. The other side was made up of the Montana Tavern Association, Gaming Industry Association, Restaurant Association, and bar owners.

We did well, made our points and painted a picture of an industry that is responsible for economic growth in our state. We made the case that the taproom is an essential source of revenue to build and grow a brewery, that we are creating jobs and opportunity in our industry and in other industries, and that our industry in Montana is thriving but is still at a disadvantage when compared to the retail privileges that breweries have in other states.

The other side took their shots at the bill and at brewers. I was dismayed that our opponents spread misinformation and made baseless allegations and during the hearing – brewers are cheating on their taxes, the MTA tries to work with us but we “declined their offer,” and the solution to more hours is just that breweries should go buy a license. You and I know that the law specifically prohibits breweries from purchasing a retail license, and while a “closely held license” is an option for some, it is not the simple solution available to everyone, as opponents would represent.

Please help get this bill out of committee and onto the House floor by delivering messages of support for HB 185:

  • Call or email committee members (see target list below)
  • Have your staff contact committee members
  • Make special efforts to contact your local legislators on the committee
  • Encourage patrons to contact the committee (they can use this online form to send a message to the entire House Business and Labor Committee)
  • Use your social media channels to spread the word – you can just share and retweet what we are posting on Facebook and Twitter.

Here are the swing votes we’ve identified in the committee. Some are leaning yes, some are leaning no, and some are completely on the fence. Your messages, especially from their local breweries, will be key.
